POSITION SUMMARY:

The Regional Head of Compliance will be responsible for leading and driving the Asia-Pacific Ethics and Compliance Program, managing the full spectrum of the compliance function from risk assessment, policymaking, SOP development, communications, training and third party compliance to enforcement, monitoring and investigations across the region.

By compliance, at Menarini we mean Anti-bribery and corruption (ABC) compliance and Trade Compliance based on the pharmaceutical industry laws and regulations, and standards set by the industry and Menarini group.

This leadership role will also be integral in providing guidance and support to the Country Compliance personnel and business teams on all aspects of the Menarini’s Ethics and Compliance Program.

KEY RESPONSIBILITIES:

• Ensure that the Company’s Ethics and Compliance Program is well designed, harmonized and implemented across the region to achieve the desired outcomes.
• Partner with the Country Compliance Leads to design, implement and administer the Company’s policies, standards and controls within the overall Ethics and Compliance framework, with the primary focus on anti-bribery and corruption compliance.
• Partner, advise and support country teams on country-specific requirements of the Compliance Program, including managing partner compliance requirements.
• Conduct and/or supervise compliance and ethics risk assessments, third party due diligence and evaluation, and associated incident handling and remedial actions.
• Deliver periodic training and communications on the Compliance Program (in-person, webinars, videoconferencing, e-learning tools) to targeted audiences.
• Prepare periodic updates for Management and Board reviews on the implementation and effectiveness of the Compliance Program and on compliance related developments across the Company’s businesses in the Asia-Pacific region.
• Monitor, evaluate and enhance the Compliance Program (including third party compliance efforts) to ensure that it is fit for purpose, effective and a competitive advantage for the Company.
• Monitor laws, regulations and industry developments relating to bribery/ corruption, compliance and ethics, and update the Compliance Program as necessary.
• Conduct and/or supervise investigations in relation to violations of the Compliance Program (independently or in collaboration with other stakeholders), root cause analysis, and make appropriate recommendations.

KEY REQUIREMENTS:

• Bachelor’s degree from a reputable university. A law degree would be advantageous.
• Internationally recognized compliance and anti-fraud certifications, if any.
• At least 10 years of ABC/trade compliance and people management experience, preferably in the pharmaceutical/ healthcare/ medical devices sectors in the Asia-Pacific.
• Knows what good looks like in building a strong Ethics and Compliance Program and able to demonstrate this strength with a proven track record.
• Strong knowledge of anti-bribery and corruption laws across the region and adept to compliance-related IT systems and tools.
• Empathetic with strong stakeholder engagement skills, including senior management.

Key Skills and Abilities:

1. Expert knowledge of a wide range of Federal program management fundamentals, laws, executive orders, regulations, policies, directives, instructions, and concepts governing functions.

2. Mastery of advanced personnel principles, concepts, practices, analytical methods, a wide range of qualitative and quantitative techniques, and relationships of various disciplines as well as seasoned consultative skill sufficient to resolve complex problems not susceptible to treatment by standard methods.

3. The candidate selected for this position will:

Manage and perform the full range of supervisory duties for direct reports and through subordinate supervisors and staff.

Oversee staff in conducting quality control reviews. Monitor compliance concerning results of quality reviews and ensure compliance through other Department Directors, Executive Management Committee (EMC) members and other management staff. Facilitate continuous improvement and quality assurance practices. Oversee process mapping along with ensuring quality management tools are utilized by staff members.

Oversee subordinate supervisors in the measurement of performance metrics and provide analytical support for the five dimensions of quality, (productivity, accuracy, cost, timeliness, service).

Brief the CMO, the Director, PBGC and other high-level senior level executives regarding the quality control program, the quality assurance program, and the business analytics program including performance measurements for implementation actions.

Counsel employees on career progress and other employment related matters. Hear and resolve grievances and or complaints which can be resolved informally and handle disciplinary matters that do not require intervention of higher officials.

Support agency objectives in employment practices, employee relations, labor relations and special programs including Affirmative Action and the Office of Equal Employment Opportunity (OEEO).

Senior Manager/Associate Director, Regulatory Compliance

Job Responsibilities

• Assist the Section Head to supervise the day-to-day functioning of the regulatory compliance team and identify and implement processes that enhance efficiency and effectiveness of the regulatory compliance function.
• Assist the Section Head in providing guidance and mentorship to members of the regulatory compliance team and promote and cultivate a good and efficient working relationship between members of the regulatory compliance team.
• Keep abreast of relevant regulatory changes and amendments, assess their impact, notify relevant staff of these changes and organize training for relevant staff and management if necessary.
• Act as strong second line of defense to provide regulatory compliance advice and guidance to business units that balances regulatory requirements, risk mitigation and business objectives.
• Serve as interface/liaison with GE Group Risk, auditors and regulators where necessary and attend to their relevant requests. Job Requirements
