SUMMARY

Plans, implements and maintains the RRH corporate compliance program to ensure the healthcare systems compliance with Social Services Law §363-d, 18 NYCRR Part 521, and the Federal Deficit Reduction Act.  Establishes compliance operational standards, policies, and procedures and designs improvements to internal control structures to cultivate an effective compliance program. Prepares and submits disclosures to government agencies under the direction of the Chief Compliance Officer in order to resolve payment discrepancies. Enhances organizational reputation, protects assets, and minimizes financial risk.

RESPONSIBILITIES

Operational Leadership. Risk Assessment & Audit. Conducts an annual risk assessment of organizational compliance risks. Advises employees and agents of the health system by analyzing and interpreting federal, state, and local laws, regulations, and contract stipulations. Provides direction to compliance team members regarding audits of the revenue cycle including, but not limited to, clinical documentation, electronic medical record work flows, registration, coding, charging, billing, payments, denials and appeals, medical necessity, financial statements, payments and attestations, grants, research, RRH employees and contractors for governmental exclusions and payment agreements.

Training & Reporting. Prepares and presents quarterly reports for the Chief Compliance Officer, Executives, and the Audit and Compliance Committee of the RRH Board of Directors. Prepares and implements annual training and educational programs for employees, agents, and governing body members on Federal and State False Claims Act, Federal Fraud, Waste and Abuse and fundamentals of an effective compliance program per federal and state guidelines.

Policy & Procedure. Develops and maintains applicable policies such as the Code of Conduct, Prevention and Detection of Fraud, Waste, and Abuse, and Conflict of Interest. Maintains and directs Departmental Compliance Committees. Develops and maintains methods of communication with the compliance function for employees, agents and board members: Facilitating and managing the system wide Compliance Hotline. Advises RRH operations in design and optimization of the electronic medical record in areas of clinical documentation, charging, coding, billing and work flows, which impacts reimbursement and compliance. Oversees administration of RRH’s Conflict of Interest Policy. Directs activities related to conflict of interest evaluation and management, including

Investigations. Directs and conducts internal investigations of reported and otherwise identified non-compliance related to fraud, waste and abuse. Assists Human Resources when investigation findings lead to employment consequences to ensure discipline of employees is fair and appropriate. Directs, facilitates and manages external investigations of RRH by agencies such as the Office of Inspector General, Department of Justice, Attorney General, Federal Bureau of Investigation, Medicaid Fraud Control Unit, Office of the Medicaid Inspector General, National Government Services, Centers for Medicare & Medicaid Services, and third-party payer Special Investigation Units (e.g. Excellus, MVP). Ensures cooperation with agencies and represents the system in a positive and professional manner.

The CRO is responsible for ensuring that the organization meets it fiduciary, legal, and duty of care requirements; setting enterprise-wide standards for compliance, duty of care, and risk management; and developing the systems, processes, and capacities to provide effective support for the mission.  The CRO also serves as a key strategic advisor and counsel for the CEO, Global Leadership Team (GLT), and the IJM Board of Directors.

The CRO reports directly to the CEO and is part of the Global Leadership Team (GLT). The CRO provides direct supervisory management to the following functions and corresponding roles: General Counsel, Global Security and Enterprise Governance and Compliance.

Responsibilities:

Leadership: Working closely with the CEO and the COO, the CRO plays a significant role in the executive leadership of IJM’s global mission and vision. • Develop, implement, and manage the structures, frameworks, and processes that equip the GLT and GLT Councils to identify enterprise-wide risks (internal and external) and make informed decisions to manage/mitigate those risks.

• Develop, articulate, and implement the governing standards on IJMs approach to risk (i.e., IJMs risk tolerance/appetite) and ensure that it is reflected in IJMs policies, operations, and activities.

• Lead the development, management, and training on IJMs crisis response framework; serve as the executive leader for enterprise crisis response.

• Regularly report to the Board and GLT on the portfolio of enterprise risks to the mission.

• Manage the standards and processes for negotiating, securing, and administering IJMs portfolio of business insurance policies.

Security:

Qualifications:

• Minimum of ten (10) years of experience holding responsibility for legal affairs/compliance in a corporate or non-profit setting, providing executive-level legal counsel in an in-house or law firm setting, and leading and managing teams of legal professionals;

• Experience working directly with and advising executive-level leadership and Boards of Directors;

• Minimum of five (5) years of experience in risk management, corporate governance, safety/security, and/or policy development/management strongly preferred;

• Experience working/providing counsel in a multi-national/global context, across multiple jurisdictions, and in cross-cultural settings strongly preferred;

POSITION SUMMARY:

The Nursing Director of Nursing Informatics & Technology is a contributing member of the nursing leadership team and directly reports to the CNO. • Minimum 8 years of total work experience with at least 3 years in a senior Learning & Development or Talent Development role working with investment professionals or client-facing professionals in an alternative assets, financial services, or top-tier consulting firm, in a capacity that requires an understanding of the business
• Experience leading strategic talent or L&D-related initiatives, as well as designing learning paths, developing curriculum, and running world-class training programs in partnership with the business
• Able to anticipate, identify and deliver strong results in a fast-paced global environment
• A demonstrated affinity to learn the business, strategy, and concepts in order to translate them into curriculum

DaVita’s well-regarded law department counsels all aspects of the company and provides legal support for all of the company’s transactions.  The attorneys are integral strategic business partners that work closely with each other and senior management on a daily basis.

This position will be based in either of the following locations:  DaVita’s World Headquarters in Denver, Colorado or our corporate business office in El Segundo, California.

Duties and Responsibilities:

The person in this position will primarily be responsible for providing advice and guidance on a wide variety of traditional labor issues that arise from the day-to-day operations of a growing, complex public company operating in a heavily regulated environment.  He/she will be part of a team that focuses on creating new strategies to support our teammates and drive efficiencies while ensuring that DaVita leads the way in being the Partner and Employer of Choice.

The following duties and responsibilities generally reflect the expectations of this position but are not intended to be all inclusive.

• Providing guidance to the Company, Senior Executives, and the Company’s Labor Relations team including, labor relations and law, union campaigns, and matters before state agencies and the NLRB.  
• Manage outside counsel on unfair labor practice proceedings, including managing costs to ensure effective use of resources.
• Conducting management training regarding labor relations and federal and California workplace issues.
• Advising senior management and DaVita business units on labor compliance and risk management to accomplish business objectives without undue risk.
• Keeping the Company’s senior management abreast of significant NLRB decisions, legislation and rulings that may affect the Company’s business or policy.
• Developing a thorough understanding of and familiarity with the Company's business, its people, markets, facilities, customers and competitors in order to identify trends and formulate appropriate structures and strategies.
• Establishing a rapport and working relationship with teammates at all levels in order to encourage and continue the proactive use of in-house legal counsel.
• Performing special assignments or projects.
• Depending on location, must be able to travel a minimum of 25%.

A successful candidate will meet the following qualifications and characteristics:

• J.D. Degree with minimum 10 years of legal experience, with 7-10 years of traditional labor experience, including labor relations and law, union campaigns, and matters before state agencies and the NLRB.
• Experience working with healthcare clients and unions (i.e., SEIU-UHW, NNU, etc.) is a plus, but not required.
• CA State bar qualification and good standing.
• Law firm experience required; additional in-house experience a plus.

Salary/ Wage Range

$146,600.00 - $215,300.00 / year

Compensation for the role will depend on a number of factors, including a candidate’s qualifications, skills, competencies and experience and may fall outside of the range shown.
