Job Purpose To act as specialist and Trust lead for the management of Claims and Redress for compensation made against the organisation and facilitate the provision of expert legal advice to frontline staff, managers and the Board in relation to Trust clinical or business activities (excluding corporate legalities). The post-holder is responsible for ensuring that claims are handled effectively and efficiently within the Trust's procedures and in accordance with 'Putting Things Right Guidance on Dealing with Concerns about the NHS from 1 April 2011,' and the Civil Procedure Rules. Knowledge, Training and Experience The post-holder will have: A Masters level qualification or equivalent experience, within a relevant field, such as law or risk management. Analytical and Judgemental Skills The post-holder will: As Public Health Wales Legal Support Manager, ensure that excellent judgement skills are used when considering options available in relation to personal injury and clinical negligence claims, ensuring the best interest of Public Health Wales are represented and explained at all times. As Legal Support Manager for Public Health Wales interpret, analyse and translate a wide range of legal, clinical and managerial information to underpin evidence based decision making and also advise and assist others in their understanding. Analyse and interpret highly complex information, where expert advice differs, eg: clinical and legal opinion and make decisions based on own experience and knowledge. Analyse claims management data so that trending can be discussed and identified. Lead on Redress matters and advise the Redress Panels under the Putting Things Right Regulations to assess levels of compensation payable where considered appropriate. This will be based on the consideration and interpretation of previous case law and Judicial College Guidelines. Support the Redress process and lead on investigations as required. This involves investigating allegations fully and effectively, including meeting with staff, seeking comments and drafting witness statements and ensuring staff co-operation and using judgement to determine what happened. Liaising with solicitors and barristers and explaining to staff (at any level) the legal implications of any advice they give to ensure the outcome of the claim is the best option for Public Health Wales. Work with Divisions to identify areas of risk and failings. Where risks and failings are identified, the Legal Support Manager is responsible for initiating an action plan that clarifies the issues that led to the admission of liability, ensuring that action taken is reviewed, monitored and audited and that final action plans are monitored through to completion via the appropriate committees. Responsible for the provision of information to the relevant management groups which will include ensuring that root causes of claims have been identified. Ensuring that action plans are used to make changes in clinical and organisation practice and procedure and facilitate education of staff as appropriate, thereby reducing risk and improving safety in the future. Responsible for analysing highly complex and often contentious investigation data to identify root causes of incidents which have led to a claim. Responsible for completing claims reports and documents to include learning from event reports, case management reports and claim reimbursement requests to the Welsh Risk Pool. Planning and Organisational Skills The post-holder will: Contribute to the annual report for claims, or prepare a separate annual report where required. In conjunction with the Board Secretary and Executive Director, develop and agree the required level of information to be reported to the Board any sub Committees thereof in respect of claims. Ensure the timely and accurate completion and submission of claim reimbursements to the Welsh Risk Pool or Welsh Government as required. Security Ensure that NHS security management work is carried out within the framework developed by NHS Protect. To ensure that an inclusive approach to security management work is taken involving both internal and external stakeholders where appropriate and necessary. Report to the Trusts lead LSMS and Security Management Director on any security management work undertaken. To ensure strong links are built with the NHS Protect and in particular, with the Area Security Management Specialists (ASMSs). Develop guidance and good working practices to tackle violence against staff and professionals in accordance with NHS Protests national framework and guidance. Ensure that the appropriate links are made with the Trusts Governance team in respect of the risk assessment process and also the Health and safety team so that security related issues are an integral part of that process. To ensure that appropriate steps are taken to create a pro-security culture within the Trust so that staff and patients accept responsibility for this issue and ensure that any security incidents or breaches that occur are detected and reported. To ensure that security incidents and breaches are published appropriately in accordance with guidelines issued by NHS Protect so that a deterrent effect is created. To ensure that lessons learnt from security incidents and beaches can be fed back into the risk analysis, both locally and nationally, so that appropriate preventative measures can be developed. To ensure that security incidents and breaches are reported, allowing for investigations to take place where appropriate, risks to be assessed and preventative measures developed. To investigated security incidents and breaches in a fair, objective manner so that the appropriate sanctions can be applied and preventative action considered. Ensures those impacted by security/violent incidents are supported. Deals sensitively and in an empathetic manner with staff members who raise complex emotive issues due to the nature of the services provided by SWFT. Apply a range of sanctions against those responsible for security incidents and breaches, working with the NHS Protects Legal Protection Unit (LPU) to ensure appropriate cases are progressed accordingly. Advise staff on security matters, both in relation to preventing violence and aggression as well as property. Establish positive working relationships with police and criminal justice services and other external stakeholders. Communicate direction and purpose clearly and openly to promote high standards of professional practice to identify and support key personnel on risk management and patient safety. Provide specialist advice, guidance and instruction regarding safety and security issues within the workplace to ensure that the Trust meets, and exceeds the statutory obligations. Develop and/or review policies, procedures for security and safety within the Trust. Provide specialist advice and support to project teams carrying out both new and rebuild developments ensuring that they are safe, include appropriate security features and that the security features are both cost effective and meet required standards. Undertakes specialised Crime Reduction Audits of Trusts facilities, evaluating current security practices and advising on appropriate crime reduction measures and actions. Provides advice on the specification of specialist equipment relating to security, including CCTV. Provide reports on security related matters as required. Ensures that an inclusive approach to security managements work is taken, involving both internal and external stakeholders where appropriate and necessary. Ensure that effective communication pathways exist between all internal and external agencies including networking with colleagues, to assist in the development of multi-professional agency understanding and working. To undertake any further training provided by NHS Protect and/or any Nationally led programs. Car Parking Management Manage the resources available for public and staff car parking to meet the objectives set out for the delivery of an overall car parking service. Ensure compliance with the Trusts strategy, policy, procedures and travel plans for car parking. Ensure that all public and staff car parking facilities are at the maximum availability at all times, that sites are clean and safe for public and staff to use, and that all equipment associated with parking is in good working order. Ensure signs and lines are in good order and suitable for the service. Ensure service provision, including maintenance of the infrastructure, enforcement, cash collection, cleaning, and equipment maintenance. Involvement with changes or variations required of any contracts associated with public and staff car parks. Monitor the delivery of car parking services provided by Soft FM contractor. Agree how key performance indicators and standards of delivery of service will be measured, and put in place such methods and data collection which will enable the delivery of services to be fully monitored. Organise and chair formal progress meetings with in-house teams and contractors to review progress, discuss ideas for improvements, and agree action plans. Review comparable car parking operations in other Trusts, adopt best practice to ensure service delivery for South Warwickshire NHS Foundation Trust improves and develops. Deal with any correspondence that relates to performance of any of the parking services. Contribute to preparation and evaluation of tenders for car parking equipment. Deal effectively with those members of the public and staff who have parking issues/complaints ensuring high levels of customer service. Develop relationships with community groups where there is a legitimate interest in matters relating to parking. Liaise with such organisations, and help to develop and promote the parking services provided by South Warwickshire NHS Foundation Trust. Assist in ensuring that all Trust legal responsibilities regarding the delivery of this service are met. Ensure that duties, which may include processing of any personal data, are undertaken within the corporate data protection guidelines and relevant legislation. Assist with obtaining Park Mark The Safer Parking Scheme for public car parks. Provide statistical information and written reports on service performance as required. To review and develop the services for which the post holder is responsible, to achieve continuous improvement and to maintain agreed performance targets. Manage the overall parking service for the Trust, for public and staff car parks. Maximise the availability of public and staff car parking provision throughout the Trust. Ensure the service provided is of a consistently high standard. Manage the day to day execution of any contracts for the management of parking operations and to ensure the delivery of the services for which contracts are in place. Manage parking compliance, and achievement of Trust objectives for enforcement and compliance. Fully maximise the Trusts revenue from parking. Provide a service which is responsive to public and staff and which meets the Trusts standards for such a service. To be responsible for the management of Parking Services in accordance with agreed Trust policies and procedures. Financial Responsibilities To proactively manage budgets under your control within agreed financial limits to provide value for money in delivering services and maximise the achievement of Trust policies. To work within the Trusts Standing Financial Instructions for Contracts and Financial Regulations. Monitor the reconciliation of monthly invoices from providers and contractors. Monitor actual financial performance against budgeted performance. Advise on and contribute to the budget preparation process. Act as the authorised signatory for specified budgets.
