Moladin is searching for a Legal Credit Senior Counsel! You will be responsible for ensuring that Moladin's operations and transactions are in compliance with all relevant regulations and legislation. You will play a critical role in ensuring the company is operating within the legal framework while maintaining the highest standards of ethics.

• Develop, maintain, and implement legal credit operational programs, including policies and guidelines, documentation, training logs, and related policies/procedures.
• Prepare legal opinion and assistance on financing contracts based on the applicable law and regulations, including drafting, reviewing, advising and obtaining the perfection of the financing and security legal documentations.
• Manage, monitor and administer the public notary to ensure the effective and efficient processing of the financing contracts, collateral checking and pledging documentations including to ensure “zero mistakes documentation” to secure the interest of the creditor when exercising its rights to a Non Performing Financing debtor. 
• Managing internal operations process with credit analyst, appraisal and custodian team to ensure an effective service level agreement based on the company standard operating procedures.
• Provide regular reporting to the management and submit accurate and timely reports to regulators (as applied) to ensure the avoidance of sanctions/fines from regulators.
• Monitor changes in laws, regulations, and industry best practices to ensure the company remains up-to-date and compliant.
• Liaise with external regulators such as the Land National Office, Ministry of Law and Humans Rights, Courts, and other related government agencies.

• Bachelor’s Degree/University degree or equivalent experience.
• Minimum of 5-10 years of relevant experience in the Legal Credit and/or Operation function of financial institutions, preferably Multifinance Company and/or Banks.
• Solid understanding of applicable laws, regulations, and industry standards, with a focus on legal credit, compliance, and corporate governance.
• Exceptional attention to detail, highly responsible, with strong integrity, commitment and discipline.
• Passionate about delivering high-quality work and exceeding expectations in a fast-paced environment.

The Role

Sundry Debt covers debts for which the council has sent an invoice. These debts are wide ranging for example, commercial rents, adult social care, licensing.

The Corporate Sundry Debt Recovery will be the professional lead on Sundry Debt collection providing technical debt recovery input to collection processes and be responsible for best practice in the area of corporate debt. Responsible for following approved processes and ensuring that policies are being adhered to.

This includes being responsible for two members of staff who are involved in the collection of Adult Social Care invoices.



You will be responsible for:

Using the council’s Agresso financial system
Extracting information from the financial system and using excel to monitor, report, and as a basis for working processes.
Managing complex and high-volume information.
Monitoring sundry debts and applying agreed processes to pursue outstanding balances. This includes negotiating payment arrangements with defaulters and arranging enforcement action where appropriate.
Providing supervision and guidance for two members of staff.
Liaising with internal and external stakeholders to obtain information to assist in the collection of debts.
Ensuring that matters relating to Adult Social Care debts are dealt with promptly, balancing the need to support the delivery of a personalised service to residents with the need to protect the council’s financial interests.



What we are looking for:

Experience of Agresso or other financial system, particularly relating to debt recovery.
Good communication skills - being able to communicate effectively and courteously with members of the public and other council departments in writing, by phone, or in person. This includes the ability to communicate well with other staff members when providing guidance and supervision.
Excellent IT skills, including the ability to show and present information in an excel format.
A self motivated individual who can work on their own initiative and be solely responsible for an area of work with minimal supervision. This requires the ability to prioritise work, to meet challenging deadlines and to be adaptable to change.
The ability to undertake repetitive and high volume of tasks whilst maintaining attention to detail and accuracy.

* Experience in preparing FBT / GST returns, cash management and forecasting.
* Understanding of IFRS requirements.

Position Description

The Sr. Manager role is part of our corporate real estate team and will report to the Director, Corporate Real Estate.  This position will focus on the structural and mechanical well-being of company owned and leased buildings. Focus areas include facility assessments, mechanical inspections, vendor management, capital budgeting, major project oversight, cost and spend analysis, and data analytics to identify improvement opportunities.

This is high-visibility role will collaborate internally with our executive leadership, operational leadership, location leadership, and functional teams (finance & accounting, legal, operations, marketing), as well as externally with landlords, brokers, environmental consultants, developers, and vendors.

Responsibilities

• Works with location leadership to manage on-going building repairs and maintenance, oversee major projects, perform building assessments and mechanical inspections, develop capital improvement plans for budgeting, standardize vendor selection and management, and benchmark operating expenses to identify potential cost savings.
• Supports the opening and closing of locations regarding building repair and maintenance activities, mechanical inspections, and specifically vendor engagement and performance to related functionality.
• Work with internal business partners to identify, analyze, and present business case justification.
• Work closely with executives and other Saddle Creek teams such as operations, solutions engineering, business delivery, finance, legal, IS, Industrial Engineering, and human resources to meet ever-changing demands of internal and external stakeholders on all CRE and facilities activity.
• Proactively provide new ideas and emerging industry trends that support internal and external stakeholders.
• Develop, maintain, report, and review standardized S&OP process flows for building asset (property) management.
• Develop, maintain, and execute processes and tools to share best practices.
• Develop and maintain positive relationships with internal and external stakeholders and act as the corporate real estate advocate on all levels of the Saddle Creek organization.

Qualifications

Education/Experience required:

• Bachelor’s degree in business, economics, engineering, finance, accounting, or related study

• Minimum of seven (7) years progressive work experience in warehouse operations or Facility Maintenance.
• Working knowledge of building mechanical systems

Education/Experience preferred:

• Working knowledge of the Third-Party Logistics (3PL) industry
• Experience in continuous improvement disciplines of LEAN, Six-Sigma a plus
• Professional Certifications (please provide)

The Technology Legal team, which is part of L&GS, provides high value strategic advice to our internal clients to support and enhance the Group’s competitive advantage in technology, business success and market value. To support delivery of this outcome, Technology Legal in collaboration with Group Procurement has implemented an Express Contracting Channel (ECC), led by a Senior Legal Counsel from Technology Legal, with support from a Legal Counsel to provide dedicated legal support for a higher volume of lower risk technology procurement projects that can be accelerated safely.

As Legal Counsel within ECC, you will report to the Senior Legal Counsel leading the ECC. This is your chance to be part of a team that embraces velocity and volume, and highly values its stakeholder relationships, both internally and externally.

Do work that matters

• Advise on the engagement of technology vendors and implementation of technology in the ECC where the focus is on accelerating the process to enable suppliers to provide the Group with products and services sooner.

• Demonstrate strong technical legal skills, including interpretation of legislation, drafting and negotiation of technology agreements, including being confident to guide stakeholders to alternate and negotiated legal positions that provide appropriate coverage.

• Communicate clearly by providing accurate, timely, commercial and succinct advice in plain English.

• Maintain a detailed understanding of, and expertise in, the Group’s practices, procedures and policies, particularly in Tech Legal, Cyber Security and Group Privacy Office, and an ability to work with those teams to safely navigate to contracts proportionate with the risks.

• Being actively engaged, excelling in client service, and being determined to simplify processes within L&GS and more broadly where applicable.

• Work proactively and productively as an L&GS team member, including a willingness to share your expertise and knowledge with others.

• Contribute to the improvement in L&GS’s work practices and knowledge management.

• Provide overflow legal support to the Strategic Sourcing Legal team in relation to Non-Tech procurement matters.

We’re interested in hearing from people who have

• Minimum two or more PQE years of relevant legal experience.

• Excellent tertiary qualifications in law and a current NSW (or equivalent) practising certificate.

• Relevant TMT experience negotiating contracts for the purchase of goods and services. Ideally, this experience includes the negotiation of SaaS agreements, managed services agreements, software licensing agreements and similar projects at a top or mid-tier law firm in Australia or in-house, preferably at a financial services institution after being trained in a law firm. Experience on privacy, data, cyber security and artificial intelligence in a financial service context is preferred.

• Strong technical legal skills, including interpretation and application of privacy and data protection laws and regulations. 

• Highly effective oral and written communication skills including the ability to provide clear, succinct plain English legal advice.

• Deep curiosity about emerging legal risks and issues in technology, data protection and cyber security.

• Excellent interpersonal and negotiation skills.

• Sound commercial acumen and pragmatic approach to providing tactical legal support to stakeholders in accordance with the Group’s PACE delivery model.

• Strong work ethic and high integrity.

• Strong organisational skills and the ability to work calmly under pressure.
