YOUR ROLE

This position will provide advice, counsel, and subject-matter expertise to CareScout, Genworth's care services business, including representing the business on existing and new product design and implementation, advertising and training materials review, operational and product initiatives. This individual will be responsible for ensuring compliance with applicable state and federal laws and regulations relating to the products and operations of the care services business.

• New Initiatives support: Support the design and development of new business initiatives, including direct-to-consumer efforts as well as ensure that initiatives align with regulatory requirements and the organization's policies
• Marketing Support: Collaborate with the marketing team to ensure compliance with relevant advertising regulations. Review marketing materials, advertisements, and promotional campaigns for legal compliance.
• Sales Support: Assist in the development of sales agreements and contracts. Provide legal guidance to the sales team on pricing, negotiations and terms and conditions.
• Technology/Web Disclosure: Stay current with healthcare technology regulations and web disclosure requirements. Advise on data privacy, cybersecurity, and HIPAA compliance related to technology and web platforms. Review and update the organization's website and online content to ensure legal compliance.
• Regulatory Compliance: Monitor changes in healthcare laws and regulations affecting the network. Collaborate with the compliance team to develop and implement compliance strategies.
• Risk Management: Identify legal risks associated with business activities and develop strategies to mitigate them.

What you bring

Required

• JD degree from an accredited school, admission to the bar of at least one state
• 10+ years’ experience as legal counsel in insurance and/or related corporate matters
• Ability to collaboratively develop strategies with the business while providing guidance on legal aspects of those strategies

• Performs complex and difficult legal analysis on a variety of legal issues independently with some supervision.
• Routinely engages with other senior leaders outside of the JMTC footprint to include the Civilian Personnel Advisory Center and other agency representatives.

• Serves as TRADOC senior labor attorney. Represents the Command in third-party administrative, quasi-judicial, and judicial proceedings on civilian personnel, labor relations, equal employment opportunity, and arbitration matters.
• Acts as TRADOC's principal trial attorney for civilian personnel, labor relations, equal employment opportunity, and arbitration cases arising within TRADOC, cases that could establish command and department-wide precedent.
• Incumbent determines case strategy and tactics; prepares prehearing motions and petitions; identifies relevant witnesses and documents via discovery procedures, including interrogatories and depositions.
• Incumbent determines what cases should be appealed. Acts as the Command representative responsible for appeal preparation or presentation of the TRADOC position.
• Develops the Command position on litigation issues that arise in conjunction with federal court and administrative tribunal proceedings.
• Evaluate legislation and regulations and directives in terms of their effect on TRADOC’s litigation policies, procedures, and operations.
• Provides oral and written advice and technical legal guidance to key TRADOC officials.
• Provides advice and prepares opinions on legal issues or factual questions, some of which lack clearly applicable precedents or contain complex factual scenarios.
• Prepares recommended course of action for senior TRADOC staff members; prepares factual analysis and legal opinions and presents oral briefings to TRADOC officials and SJA supervisors.
• Prepares written opinions and renders legal advice on a wide variety of administrative law matters.
• Conducts legal research using current agency directives and regulations, federal and state law judicial and administrative opinions, memoranda and staff papers for commanders/staff.
